Enlightened Circle Foundation (ECF)
01. INTRODUCTION & LEGAL ACCEPTANCE
These Terms of Use (“Terms”) govern access to and use of all services, platforms, programs, and offerings provided by Enlightened Circle Foundation (“ECF”, “we”, “our”, “us”).
These Terms apply across all interfaces including:
- Official website(s)
- Learning Management Systems (LMS)
- Mobile applications (including Swadhyan App and future platforms)
- Online and offline programs
- Retreats, satsangs, and events
- Membership communities
- Digital content and resources
By accessing, registering, enrolling, or participating in any ECF offering, you (“User”, “Participant”, “Member”) agree to:
- Be legally bound by these Terms
- Comply with all policies, including Refund Policy and Code of Conduct
- Use the platform and services in a lawful and respectful manner
If you do not agree, you must discontinue use immediately.
02. NATURE OF SERVICES
ECF provides spiritual, educational, and community-based services, including but not limited to:
- Meditation and self-development programs
- Guided sessions, satsangs, and retreats
- Digital courses, recordings, and content
- Membership-based community access
- Events, workshops, and experiential engagements
Important Clarification
- ECF services are not medical, psychiatric, or therapeutic treatment
- They are intended for personal growth and spiritual development
- Participation is voluntary and self-directed
03. USER ELIGIBILITY
By using ECF services, you confirm that:
- You are at least 18 years of age, or accessing under parental/guardian supervision
- You are legally capable of entering into binding agreements
- You will provide accurate and complete information
ECF reserves the right to deny access to any individual at its discretion.
04. ACCOUNT REGISTRATION & SECURITY
Where applicable, users may be required to create an account.
You agree to:
- Maintain confidentiality of login credentials
- Be responsible for all activity under your account
- Notify ECF immediately in case of unauthorized access
ECF shall not be liable for losses arising from misuse of your account.
05. CODE OF CONDUCT (MANDATORY COMPLIANCE)
All participants are required to adhere to ECF’s community standards.
Users shall NOT:
- Disrupt sessions or community interactions
- Use abusive, offensive, or inappropriate language
- Harass, threaten, or disrespect mentors or participants
- Promote external agendas or solicitations
- Record or distribute sessions without authorization
Sanctity Clause
ECF operates as a discipline-based spiritual environment.
Participants are expected to engage with sincerity, respect, and responsibility.
Violation may result in:
- Immediate suspension
- Permanent removal
- Forfeiture of access without refund
06. INTELLECTUAL PROPERTY RIGHTS
All content provided by ECF, including but not limited to:
- Videos, audios, and recordings
- Meditation practices and teachings
- Course materials and documents
- Branding, logos, and design elements
are the exclusive intellectual property of ECF.
Users are strictly prohibited from:
- Recording sessions (audio/video/screen capture)
- Reproducing, distributing, or sharing content
- Using content for commercial or public purposes
- Creating derivative works
Unauthorized use may result in:
- Legal action
- Permanent access termination
07. PAYMENT TERMS & FINANCIAL COMMITMENT
All payments made to ECF are governed by the Refund, Cancellation & Payment Policy.
By making payment, you acknowledge:
- Payments are non-refundable except under defined conditions
- Access is granted upon confirmation
- Fees represent commitment to participation, not purchase of goods
ECF reserves the right to:
- Modify pricing
- Introduce new fee structures
- Offer limited-time programs or memberships
08. MEMBERSHIP & ACCESS RIGHTS
Membership or enrollment grants:
- Limited, non-transferable, revocable access
- Valid only for the specified duration
ECF reserves the right to:
- Modify program structure or access
- Revoke membership in case of violations
- Update offerings without prior notice
09. DISCLAIMER OF WARRANTIES
ECF provides services on an “as-is” and “as-available” basis.
ECF makes no guarantees regarding:
- Specific outcomes or results
- Personal transformation or benefits
- Continuous or error-free access
Participation outcomes depend on:
- Individual engagement
- Consistency of practice
- Personal circumstances
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- ECF shall not be liable for any indirect, incidental, or consequential damages
- ECF’s total liability shall not exceed the amount paid by the user (if applicable)
This includes, but is not limited to:
- Loss of data
- Emotional or psychological expectations
- Disruptions in service
11. HEALTH & PERSONAL RESPONSIBILITY DISCLAIMER
Participants acknowledge that:
- Meditation and spiritual practices may have emotional or psychological effects
- Participation is voluntary and at personal discretion
ECF is not responsible for:
- Medical conditions
- Psychological responses
- Personal interpretations of teachings
Users are advised to seek professional medical guidance where required.
12. TERMINATION & ACCESS REVOCATION
- Data of individuals under 18 is collected only with parental consent
- Any inadvertent collection will be rectified and deleted
13. FORCE MAJEURE
ECF shall not be liable for failure or delay due to events beyond control, including:
- Natural disasters
- Government restrictions
- Technical failures
- Public emergencies
Programs may be:
- Rescheduled
- Modified
- Deferred
14. PRIVACY & DATA USAGE
User data is handled in accordance with ECF’s Privacy Policy.
By using ECF services, you consent to:
- Collection of necessary personal information
- Communication related to programs and updates
ECF does not sell or misuse user data.
15. THIRD-PARTY LINKS & SERVICES
ECF may provide access to third-party platforms or tools.
ECF is not responsible for:
- Content or policies of third-party services
- External platform performance or failures
16. INDEMNITY
You agree to indemnify and hold harmless ECF from:
- Claims arising from misuse of services
- Violation of Terms
- Unauthorized actions or conduct
17. MODIFICATION OF TERMS
ECF reserves the right to update or modify these Terms at any time.
- Continued use constitutes acceptance of revised Terms
- Users are responsible for periodic review
18. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
